1. Provider and scope

These Terms and Conditions apply to the use of the online portal ValueStockFinder.

The provider and contractual partner is Beaufort AG, a Swiss stock corporation with its registered office at Im Hochrain 2, 8102 Oberengstringen, Switzerland, UID/VAT No. CHE-255.825.301 MWST.

ValueStockFinder is offered worldwide to users who want to independently inform themselves about listed companies, stock metrics, fundamental analyses, valuation indicators and market data. The currently supported languages are German and English.

2. Service description

ValueStockFinder is a digital information portal for stock analysis. The portal provides, among other things, AI-generated fundamental analyses, compact ratings, metrics, historical comparisons, alerts, valuation indicators and notes on possible analysis or timing opportunities.

The content is provided solely for general information and to support your own research. ValueStockFinder is not an investment adviser, asset manager, financial intermediary, broker or provider of individual investment advice.

The analyses are generated fully automatically and with the support of artificial intelligence. They may be updated or newly generated, in particular after the publication of quarterly or annual results. The financial data used may be delayed, incomplete or incorrect. Price and fundamental data are generally not real-time data, but available historical or delayed data, for example data from the previous day.

ValueStockFinder may further develop, modify, supplement or discontinue the scope of functions, presentation, calculation methods, data models, data sources, analysis methods and rating systems at any time. Users will be informed of material changes in an appropriate manner.

3. No investment advice and no investment recommendation

ValueStockFinder expressly does not provide investment advice, financial advice, tax advice, legal advice or individual investment recommendations.

All content, analyses, ratings, scores, signals, alerts and notes are general information. They do not take into account your personal financial situation, investment objectives, risk profile, knowledge, experience, investment horizon or tax situation.

Terms such as “buying opportunity”, “timing chance”, “valuation chance”, “signal”, “attractive”, “cheap”, “wait” or similar wording are to be understood exclusively as analytical indicators within the portal. They do not constitute a request, recommendation or advice to buy, hold or sell financial instruments.

You make every investment decision entirely on your own responsibility. Before making any investment decision, you should review the information yourself and seek independent professional advice if necessary.

4. Registration and user account

Registration is required to use ValueStockFinder. Registration takes place with a personal user account and email verification.

A user account is personal and may only be used by the registered person. Sharing login credentials, account sharing or use of one account by several persons is not permitted.

You are obliged to keep your login credentials confidential and to protect your account against unauthorised access. If you suspect that third parties have access to your account, you must inform ValueStockFinder immediately.

You may only create multiple accounts if this is not done to circumvent technical, contractual or payment-related restrictions.

5. Free trial period

ValueStockFinder may offer a free trial period. The current trial period is seven days.

No payment method is required for the free trial period. The trial period does not automatically convert into a paid subscription. A paid subscription only arises if you explicitly subscribe to one.

After the trial period expires, access to paid features may be restricted or terminated unless a paid subscription is concluded.

6. Subscriptions, prices and payment

ValueStockFinder offers paid subscriptions. Currently, monthly and annual subscriptions are available.

The current monthly price is CHF 24.90. The current annual price is CHF 239.00.

Prices are exclusive or inclusive of applicable statutory taxes, depending on how they are displayed in the order process. The applicable VAT or comparable tax may vary depending on country, place of residence, billing address and applicable legal requirements and will be shown in the order or invoicing process.

Payment processing is carried out through a payment service provider used by ValueStockFinder. The specific payment service provider may change and will be displayed during the payment process.

ValueStockFinder may offer vouchers, discounts, introductory offers or special terms. Such offers apply only under the stated conditions and do not create any entitlement to future discounts.

7. Term, renewal and termination

A subscription runs for the term selected during the order process. Monthly and annual terms are currently offered.

A subscription renews automatically only if you have expressly agreed to automatic renewal or if this was clearly indicated during the order process.

You may cancel your subscription at any time before the end of the current term through your account. The cancellation ends the subscription at the end of the already paid term. Until then, access to the paid features generally remains active.

Refunds in case of early cancellation are excluded unless mandatory law provides otherwise or ValueStockFinder expressly agrees otherwise.

In the event of a permanent complete outage of the service, ValueStockFinder may, at its own discretion, refund the pro rata amount for the current paid subscription period.

8. Right of withdrawal for consumers

If you order as a consumer residing in a country where a statutory right of withdrawal applies, your mandatory statutory rights remain unaffected.

Because ValueStockFinder provides digital content and digital services immediately after contract conclusion, you may be required during the order process to expressly agree that ValueStockFinder begins performance before the expiry of any withdrawal period. To the extent permitted by law, this may cause your right of withdrawal to expire or be restricted.

Further information on the right of withdrawal may be provided during the order process or in a separate withdrawal notice.

9. Availability and technical limitations

ValueStockFinder endeavours to ensure high availability of the portal. However, continuous, error-free or uninterrupted availability at all times is not guaranteed.

ValueStockFinder aims for technical availability of 99.9%. This excludes, in particular, planned maintenance, updates, security measures, disruptions at third-party providers, payment service providers, hosting providers, data suppliers, network operators and events outside ValueStockFinder’s control.

The portal may be temporarily restricted or unavailable due to maintenance, further development, security reasons, technical problems or force majeure.

10. Data quality, corrections and changes

ValueStockFinder works with financial data, company data, market data and automatically generated evaluations. Such data may be incorrect, outdated, delayed, incomplete, misassigned or temporarily distorted by events such as stock splits, dividends, special events, corrections or data provider errors.

ValueStockFinder does not warrant the accuracy, completeness, timeliness, availability or suitability of the provided data and analyses for any specific purpose.

ValueStockFinder may subsequently correct, recalculate or remove historical data, metrics, analyses, charts, calculations and scores if ValueStockFinder considers this appropriate or necessary.

11. Limitation of liability

Use of ValueStockFinder is at your own risk.

ValueStockFinder is not liable for investment decisions, investment losses, lost profits, indirect damages, consequential damages, data errors, delays, incomplete information, incorrect analyses, technical disruptions or unavailability of the portal.

ValueStockFinder is liable only to the extent that liability cannot be excluded or limited under mandatory law, in particular in cases of intentional or grossly negligent conduct or mandatory statutory liability.

12. Permitted use and usage restrictions

You may use ValueStockFinder only in accordance with these Terms, applicable laws and the intended functions.

In particular, the following are not permitted:

• sharing your account or login credentials with third parties,
• automated scraping, crawling, bulk downloads or other automated access without prior written consent,
• attempting to circumvent technical protection measures, access restrictions or usage limits,
• commercial reuse of content without prior written consent,
• using the portal for unlawful, abusive or security-threatening purposes,
• systematic reproduction, storage or redistribution of content outside the intended scope of use.

You may share individual content, analyses or excerpts for private or editorial purposes, provided that ValueStockFinder is clearly and visibly named as the source and the presentation is not misleading. Commercial use, systematic publication or further exploitation is permitted only with ValueStockFinder’s prior consent.

13. Intellectual property

All rights in ValueStockFinder, in particular in software, user interface, database structure, layout, texts, analyses, scores, ratings, graphics, trademarks, concepts, calculation logic and other content, belong to Beaufort AG or the respective rights holders.

By taking out a subscription, you receive a simple, non-exclusive, non-transferable, revocable right to use ValueStockFinder personally during the contract term.

These Terms do not transfer any ownership rights, copyrights, trademark rights, database rights or other intellectual property rights to you.

14. Communication and data protection

ValueStockFinder may send you transactional emails, in particular regarding registration, email verification, password changes, payment, contract administration, security and important system notices.

In addition, ValueStockFinder may send you product information, information about new features or newsletters, provided this is legally permissible or you have consented. You can unsubscribe from marketing communication using the respective mechanisms provided.

ValueStockFinder may analyse usage data in anonymised or aggregated form in order to improve the stability, security, usability and quality of the portal. Personal data is treated confidentially and is not sold to third parties.

15. Suspension and termination by ValueStockFinder

ValueStockFinder may temporarily suspend your account or terminate the contract for cause.

Cause exists in particular in the event of:

• breach of these Terms,
• abusive or unlawful use,
• account sharing,
• automated access without consent,
• default in payment,
• security risks,
• attempts at manipulation,
• infringement of rights of ValueStockFinder or third parties.

In the event of serious or repeated breaches, ValueStockFinder may suspend access without prior notice.

16. Data after contract termination

After cancellation or expiry of a subscription, your user account may remain in place so that you can reactivate it later.

Stored data such as settings, lists or usage data will generally continue to be stored unless deletion is requested or statutory retention obligations prevent deletion.

You may request deletion of your account and personal data. Deletion will be carried out in accordance with applicable data protection laws and the separate privacy policy.

17. Changes to these Terms

ValueStockFinder may amend these Terms if this is necessary or appropriate due to legal, technical, economic or functional developments.

You will be informed of material changes by email or by a notice in the portal. Changes apply from the date communicated.

If you do not agree with the changes, you may cancel your subscription as of the date on which the changes take effect. In this case, ValueStockFinder may refund the pro rata amount for the unused paid term if the change materially affects your contractual position.

If you continue to use ValueStockFinder after the amended Terms come into effect, the changes are deemed accepted to the extent permitted by law.

18. Final provisions

If any provision of these Terms is or becomes invalid in whole or in part, the validity of the remaining provisions remains unaffected.

ValueStockFinder may transfer rights and obligations under the contract to affiliated companies or legal successors, provided this does not result in material disadvantages for you.

Swiss law applies, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions at the user’s place of residence remain reserved.

The place of jurisdiction is Zurich, Switzerland, unless a mandatory statutory place of jurisdiction applies.
